Quality, Costs and Benefits in ADR proceedings for medium-sized disputes in Spain with reference to Construction - Energy / EPC / OEM, Industry 4.0 - IoT / IP and Family Businesses

The third edition of the annual ADR Days took place on the premises of the Universitat Pompeu Fabra, Barcelona, on May 24th 2019 – jointly organized and hosted by ICC Spain, AHK, Rödl & Partner, Cuatrecasas, Roca Junyent, Uría Menéndez, Anzizu, López & Castellanos, Pérez-Llorca, Marimón Abogados and J&A Garrigues Abogados.

After the opening speech given by Jordi Sellarés, of ICC Spain, and Melanie Gierth of the CCA/AHK, Madrid, Patricia Saiz from ESADE, addressed the subject of the advantages and benefits of ADR proceedings for medium-sized disputes in Spain according to ICC expedited Procedure Provisions.

The ADR day continued with three roundtable discussions related to the practice, challenges and results of ADR proceedings concerning Negotiation, Mediation and Arbitration in various business areas. The first roundtable, moderated by Jordi Sellarés and with the participation of the panelists Alba Solano (Uría Menéndez), Irene Nuviala (Universidad de Zaragoza) and Marlen Estévez (Roca Junyent), focused on the construction, energy, EPC and OEM sectors.

The second roundtable, moderated by Ayllen Gil Seaton, Associate Professor in Litigation at the Universitat Pompeu Fabra and the panelists Ana Ribó (Perez-Llorca), César Rivera (Cuatrecasas) and Jochen Beckmann (Rödl & Partner), focused on the 4.0., IoT and IP industries:

The last roundtable of the day, moderated by Ignacio de Anzizu and with the panelists Alberto Sola (Europer), Carlota Paytuvi (J&A Garrigues), Esther Dominguez (Marimón Abogados) and Gerard Sartorio (Sartorio Abogados), emphasized the special challenges of arbitrage in family businesses.

Thanks to the various speech contributions of experts and practitioners the actual challenges, e.g. the requirements an arbitration judge should meet, as well as the increasing relevance of arbitration were well explained.

Summary ADR Days 2018

The 16th November 2018 saw the second of our annual ADR days at the Universitat Pompeu Fabra, Barcelona. This year was jointly organised and moderated by Jochen Beckmann of Rödl & Partner and Ayllen Gil Seaton, Associate Professor of UPF.

The morning session consisted of three talks:

Sebastian Kneisel of Boris Hennecke Kneisel, Cologne spoke about Best Practices and Process Efficiency in Arbitration, focusing on the IBA Compendium of Arbitration Practice, the newly released DIS Arbitration rules and his analysis of the first draft of the yet to be released Prague Rules. He emphasized the importance of the quality of Arbitrators in the efficiency of proceedings, rather than a simple reliance on an efficiency blueprint. A lively discussion followed with a general agreement that a client should be made aware of the possibility and effectiveness of arbitration as an alternative to judicial proceedings from the very inception of any project, ideally before any contract is signed, rather than after a problem has arisen, and maybe through the inclusion of dispute resolution in non-legal studies.

Denise Wiedemann of the Max Planck Institute in Hamburg spoke on balancing arbitral independence and quality control, with particular reference to the institutional review of arbitration awards. The focus was on internal reviews rather than any subsequent review by state courts centering on the ICC scrutiny process. Discussion centered on Wiedemann’s experience of scrutiny in Mexico and the issue of adequate manpower and resource allocation to cover any scrutiny process.

Korinna von Trotha of the German Arbitration Institute (DIS), Berlin spoke on costs in arbitration proceedings, an issue, she noted, that was little covered in legal literature.
Issued that were covered included whether costs should be based on the amount in dispute (DIS and most other institutions ) as opposed to an hourly rate (still used by some); the costs of an arbitration hearing versus judicial proceedings in both Spain and Germany (amounts which varied greatly) and the exclusion of VAT from many initial costs estimates. She also discussed costs awards and the inclusion in certain cases of “punishment amounts” for bad faith conduct of the case itself.

The afternoon session consisted of two roundtable discussions with a short introduction by panel members followed by questions and comments from both the audience and panel.

The first roundtable covered the area of Construction with discussion covering the complexity of multi-party contracts involved in this type of matters, early dispute avoidance systems, including dispute boards provided for in construction contracts and mediation, as well as the status and enforcement power of any such systems. Marlen Estévez of Roca Junyent and Irene Nuviala Lapieza of the University of Zaragoza were able to bring their extensive experience both as counsel and as an arbitrator to the table. Jose Manuel Mazda of Real Madrid C.F. and Christian Belte of CMG Zubieta UTE were able to bring an industry perspective to the discussion. Finally, Jochen Beckmann with a view to future developments in the field of industrial plant engineering (EPC 4.0) led to the subsequent roundtable of IoT and Industry 4.0.

This second roundtable was focused on IoT / Industry related to IP issues.. David Pellisé spoke of the role of ADR in IP contracts and specialization within the arbitral tribunal system on these complex matters. Manuel Lara of FESTO spoke of Industry 4.0 and the role ADR could play in the resolution of disputes arising from increasing interchange of data. Jordi Ilario of FRACTUS discussed the role of mediation as well as judgement in proceedings, referring to his experience in Texas. The afternoon ended with a discussion contribution from Ayllen Gil Seaton of the University Pompeu Fabra regarding the Scope of Arbitrability in the New Spanish Patent Law (Art. 136 Ley 24/2015).

Summary ADR Days 2017

The first of our Annual ADR Days took place on the 17th November 2017 at Universitat Pompeu Fabra, Barcelona. Organised and hosted by Dr. Carlos Gomez Ligüerre of UPF and Dr. Jochen Beckmann, Barcelona who acted as moderators throughout the day.

The morning session focused on the work of the DIS, German Institution of Arbitration with three speakers providing a comprehensive overview of the working of the institution and forthcoming changes.

Dr. Stefan Kröll of Bucerius Law School, Hamburg gave a wide-ranging introduction to the DIS and its methodology in which his knowledge as both a scholar and practitioner proved extremely valuable.

Dr Jan Kleinheisterkamp of the London School of Economics discussed the differences between the role of judges in the German civil law system versus that of judges in common law jurisdictions and the implications this has for the work of German arbitrators.

Korinna von Trotha provided an analysis of the costs involved in bringing a DIS arbitration case and was able to provide additional knowledge about forthcoming changes to the DIS rules.

The afternoon roundtable proved to be a lively discussion between panel members and the audience. It moved beyond DIS and German arbitration cases to incorporate the extensive experience of the panel in local Spanish and international arbitration cases.

Each panel member was able to speak about their particular area of expertise: the role of arbitration in Construction law from Rafael Montejo of Osborne Clark, Madrid; arbitration in relation to Capital Markets and Private Equity in the case of Malen Estevez of Roca Junyent, Madrid. David Pellise of Pellise Advocats spoke about his speciality of IP law and Jordi Sanchez Sanchez-Crespo of Rousand Costas Duran discussed practical problems he had encountered dealing with individual arbitrators and a system which to date involves no appeal process.
